KUWAIT CITY, Nov 30: The Civil Court has issued a ruling requiring a woman to pay approximately 54,000 dinars to her former husband as compensation for occupying his home for a period of six years.
According to lawyer Nawaf Al-Wahib, who filed the lawsuit, his client had previously transferred ownership of part of the property to the defendant as a gift during their marriage. However, this transfer was later invalidated by a court ruling, which annulled the gift and restored full ownership to the plaintiff.
Al-Wahib explained that in 2019, following the couple’s divorce and the court’s decision to revoke the gift, his client formally requested that the defendant vacate the property. Despite this request, she refused to leave, compelling him to remove her by force to regain possession of the home.
The court determined that her continued occupation of the property after the revocation of the gift constituted unlawful use, thereby entitling the plaintiff to financial compensation for the six-year period in which she remained in the home without his consent.
