Gift Dispute: Court Rules Against Return Request in Divorce Battle

KUWAIT CITY, Jan 24: The Personal Status Court rejected a Kuwaiti citizen’s request to oblige his ex-wife to return some gifts he had given her during the marriage. The court affirmed that he had no right to demand their return. The defendant’s counsel Lawyer Hawraa Khala Al- Habib said in her plea that there is nothing in the law or even Sharia that requires the return of gifts except for the financial debt written between the spouses, for which there is the right to demand its return. Lawyer Al-Habib said, “We hope that the rivalry does not overshadow principles. When a person gives gifts, he gives them because the other party deserves them from his point of view. Just as a person lives bad days, he must not forget that he lived beautiful days. We must adhere to the advice of the Quran – So do not forget the goodness between yourselves”.
