Former MP accused of real estate fraud to pay Kuwaiti citizen

KUWAIT CITY, Oct 11: In a final and deterrent ruling for companies involved in real estate fraud, the Court of Cassation ordered a famous real estate company owned by a former MP accused of real estate fraud to pay a citizen KD100,000 — the value of a chalet, and KD30,000 compensation for the damages he sustained, says Al-Seyassah.

The citizen’s lawyer, Attorney Ali Al-Ali, disclosed that based on a usufruct sale contract concluded between his client and the company, the latter sold to him the usufruct of a chalet in a resort in Nuwaiseeb for a price of KD100,000. The plaintiff paid the full amount upon signing the contract.

However, he later realized that the project does not exist and that he had fallen victim to fraud as it was agreed between the two parties that the plaintiff would conclude the contract for selling the chalet again to the plaintiff — the subject of the dispute. This was done on the condition that the defendant refunds the amount in accordance with the contract.
