KUWAIT CITY, Dec 7, (: The Minister of State for Municipal Affairs and Minister of State for Communications Affairs Fahd Al-Shoula has issued a ministerial decision requiring the formation of a fact-finding committee to review the administrative and legal measures taken by the Kuwait Municipality regarding the exploitation of state lands not subject to petroleum operations by contractors contracting with the Kuwait Oil Company, headed by Counselor Sarah Al-Eid, and with membership of both advisors, Hassan Al-Saffar and Abdul Latif Al-Duwailah.
Al-Shoula stated in his decision that the committee will be responsible for reviewing the decisions and licenses issued by the municipality, regarding a site exploited by one of the companies contracting with the Kuwait Oil Company, to indicate whether that occupation is based on a basis of law, or was carried out in violation of the regulations and decisions in force in the municipality, and in the case Finally, a statement of the administrative and legal measures taken regarding these violations in accordance with applicable regulations.
He added that the committee will work to verify the validity of the legal measures taken by the Kuwait Municipality, regarding a number of violation records, in light of the legal opinion issued by the Fatwa and Legislation Department, which includes the right of the municipality to take the necessary measures against the company, and to demand state benefits for the incident of occupancy that violates the law, A statement of whether that opinion was taken or not, and in the second case, a statement of the reasons for that.
Al-Shoula pointed out that one of the tasks entrusted to the committee is to review all administrative and legal measures taken by the Kuwait Municipality regarding a number of violations reports in light of the laws, regulations and decisions followed in this regard, and to indicate whether or not those procedures are marred by any shortcomings or violation of the provisions of the law and the governing regulations. In the last case, a statement of the deficiencies, identifying the culprit, and specifying all legal and administrative measures that must be taken by the municipality in order to preserve public money.
The decision specified the duration of the committee’s work as one month, starting from the date of its first meeting or until the completion of its work and completion of its mission, whichever comes first.
