Expat Businessman Ordered to Pay KD39,788 for Unpaid Meat Supply Bills

KUWAIT CITY, June 18: The Commercial Court of Appeals overturned a lower court ruling that had dismissed a lawsuit filed by a company specializing in the supply of meat and food items, reports Al- Seyassah daily. The court ordered an expatriate businessman to pay the company KD 39,788.273 for goods supplied to him, in addition to court costs and KD 200 in legal fees. The company’s lawyer, Ali Matar Al-Wawan, filed the lawsuit, requesting that the defendant be compelled to pay the outstanding debt resulting from the supply of meat and food items between 2016 and the end of 2023.

The case was based on invoices and account statements proving the commercial transactions between the two parties. The court relied on the report of the appointed expert, which confirmed the debt of KD 39,788.273 owed by the defendant to the company. The court rejected the company’s request to impose legal interest on the defendant, explaining that, following the invalidation of the agreement between the two parties, the claim was based on the principle of unjust enrichment, a civil obligation for which late payment interest is not permissible. Lawyer Ali Matar Al-Wawan relied on the documents, invoices, and account statements that proved the amount of the debt owed to the company.
