KUWAIT CITY, Feb 22: The Court of Appeals ordered the eviction of a trespasser from a commercial property and obligated him to pay around KD 28,000 as compensation for damages and losses resulting from his illegal occupation. The ruling favored a commercial company after the court determined that the trespasser occupied the property unlawfully.
This necessitated ending the trespassing and returning the property to its rightful owner, thus protecting legal standing and safeguarding commercial rights. A report from the General Department of Experts at the Ministry of Justice reinforced this ruling. It concluded with a settlement of accounts between the two parties, determining outstanding amounts — including unpaid rent, electricity, and water consumption — and calculating lost profits from the company being deprived of using its premises during the dispute.
The report ultimately confirmed the total compensation of about KD28,000. This ruling conveys a clear message -- the judiciary not only returns the property to the rightful owner, but also holds the trespasser fully responsible for all financial consequences. Attorney Jarrah Hamid Al-Sharika, who is currently leading the Nasq Law Firm and Legal Consultations, handled the lawsuit and followed up its stages. He described the ruling as “remarkable”.
