Employer acquitted in case of labor law

KUWAIT CITY, April 13: The Misdemeanor Court of Appeals upheld the verdict issued by a lower court which acquitted an employer in a case of labor law violations in the private sector. The charges included bringing in and employing expatriate workers without a genuine need for them.

The acquittal was based on the lack of sufficient evidence. The case revolved around an employer accused of bringing in expatriate workers from outside Kuwait and employing them despite a lack of actual need for them, in violation of Articles 2/10 and 138 of Law No. 6/2010 concerning labor in the private sector and its amendments.

The charges were based on an inspection report indicating that the registered establishment had no physical location, despite having registered employees on its file. The defense counsel lawyer Mohammad Al-Jassem maintained the validity of his client’s legal position, presenting defenses and evidence that the court deemed sufficient to support the acquittal. The case file lacked conclusive evidence to substantiate the charges. The court affirmed the validity of the appealed ruling and its conformity with the law. Accordingly, the court decided to reject the appeal and uphold the acquittal.
