Delivery theft charges dropped against expat

KUWAIT CITY, Feb 15: The Court of Appeals overturned the Criminal Court’s ruling that had sentenced an individual to three years’ imprisonment with hard labor and deportation from Kuwait for allegedly stealing items from a delivery vehicle. The court instead acquitted the defendant of all charges. The Public Prosecution had previously charged the defendant with breaking the window and lock of a delivery vehicle at night and stealing a mobile phone and cash. The Criminal Court had sentenced the defendant in absentia to three years’ imprisonment with hard labor, deportation from Kuwait, and ordered payment of KD 100 in legal fees.

Following the ruling, the Public Prosecution appealed, seeking a harsher sentence, while the defendant filed an appeal seeking acquittal. The defendant argued that the confession attributed to him was invalid and that the case file lacked conclusive evidence to support a conviction, also requesting leniency based on the victim’s waiver of rights. Lawyer Inaam Haidar submitted a memorandum to the Court of Appeals and presented arguments emphasizing that there was insufficient evidence to convict her client.
