Debtor fails to escape law

KUWAIT CITY, April 28: The Court of Appeals overturned the ruling of a lower court that dismissed the case filed against a debtor residing in London. The higher court ordered the defendant to pay two women a total of £69,900 (or its equivalent in Kuwaiti Dinars), plus court costs and attorney’s fees. The court also granted the plaintiffs the right to track the assets of the debtor and take enforcement measures against his holdings and shares abroad in accordance with the law. The case was filed when the two appellants, who owned shares in a London-based company, agreed with the defendant to sell these shares to him.

However, he failed to fulfill his obligation to pay the agreed amount, prompting them to seek legal recourse to claim their rights. The Court of First Instance dismissed the case, but the Court of Appeals found the ruling flawed in terms of the application of the law and deficient in its reasoning. The Court of Appeals affirmed the defendant’s obligation to pay the value of the disputed shares, as per the signed contract and the documents related to the case. The court also ruled the case inadmissible against the second respondent, because it was filed against an unauthorized party. The two women were represented by Attorney Houra Al-Habib who presented arguments and submitted memoranda and documents affirming her clients’ rights, which the court upheld in its final ruling.
