KUWAIT CITY, Jul 6: Kuwait's Court of Appeals has upheld a lower court ruling acquitting two defendants of manslaughter charges in connection with a fatal hit-and-run accident on the Fourth Ring Road that claimed the life of an Asian woman.
In its judgment, the appeals court ruled that prosecutors failed to prove the essential element of fault required to establish the offense of manslaughter. The court said the case file did not contain sufficient evidence showing that either defendant acted recklessly, negligently, or in violation of traffic laws.
According to the ruling, evidence and witness testimony indicated that the victim attempted to cross the highway from a location not designated for pedestrians, a key factor in the court's decision to uphold the acquittals.
The court concluded that there was no proof that the defendants had engaged in any conduct that directly contributed to the fatal collision through negligence or misconduct.
Defense lawyer Khalil Haidar, who represented the second defendant, welcomed the verdict, stating that the prosecution had failed to establish the legal elements of manslaughter. He argued that his client had been driving lawfully on a road designated for vehicle traffic and had committed no traffic violation.
The ruling brings the criminal proceedings against the two defendants to a close, reaffirming the earlier acquittal issued by the lower court.
