KUWAIT CITY, Jul 2: The Court of Appeal has upheld a ruling requiring a Gulf national resident to officially register his marriage and pay his wife the agreed dowry of KD35,000.
The court ordered the husband to obtain an official marriage certificate from the Sharia Documentation Department, affirming the validity of the marriage contract and the agreed-upon dowry.
The ruling came in response to a lawsuit filed by the wife seeking formal registration of the marriage and recognition of her legal and financial rights after the husband allegedly refused to complete the official documentation.
Representing the wife, lawyer Alaa Al-Saeedi argued that the husband's refusal to register the marriage contract did not invalidate the marriage or deprive the wife of her legal entitlements. She stressed that once the marriage agreement and dowry were established, the dowry became a debt legally owed by the husband.
The Court of Appeal agreed, confirming both the validity of the marriage and the husband's obligation to fulfill the agreed financial commitment.
