Court dismisses case against investor

KUWAIT CITY, Dec 12: The Court of Cassation dismissed a lawsuit filed by a trading company against a Kuwaiti investor at Qurain Markets. The final ruling nullified the verdict of the Court of First Instance upheld by the Court of Appeals, which ordered the defendant to pay over KD10,000 rent values covering the period of using the shops in contention until the time of eviction. Lawyer Ali Al-Ali, counsel to the citizen, disclosed that his client rented shops from the company since 2009 for KD 190 per month but refused to pay the rent until the time of litigation, because the company breached an agreement concerning the renewal of license. He said witnesses testified that the man didn’t make use of the shops since Kuwait Municipality issued notice of the violation, saying the location was meant for vocational activities rather than trade. He pointed out that the company misled his client and many others by encouraging them to invest there.
