Court changes sentence of a Kuwaiti in drug related case

KUWAIT CITY, Apr 11: The Court of Appeals upheld the verdict issued by another court of Appeal which canceled the ruling issued by the Criminal Court in absentia to sentence a Kuwaiti citizen to three and a half years with hard labor, and instead abstained from uttering its punishment with a guarantee of KD 200 and maintain good conduct for a year.

The citizen was charged with possession of cannabis and psychotropic substances with the intent to use, violation of traffic rules and non-compliance with police orders.

According to the testimony of the arresting officer who was patrolling the area of the arrest, an unidentified person informed him about an unknown car parked in an open yard in front of his house. As he approached the car, the driver and a person with him stepped out of the car and began running, throwing behind some substances and tools, which the officer suspected were used for consuming narcotics.

The officer managed to catch up with one of the two but after searching him, no illegal substances were found on him, even though he appeared to be in a disoriented state.

According to Lawyer Abdullah Al-Alanda who represented the citizen, the police did not have any probable cause to stop, arrest and search his client. All evidence produced by the prosecution was circumstantial, and not enough to prosecute his client due to lack of direct link between the confiscated substances and his client.
