KUWAIT CITY, Jun 3: The Court of Appeals ruled in favor of a woman from a Western North African country who had married a Kuwaiti citizen, overturning a lower court’s decision to dismiss her claim for proof of marriage. The court confirmed the marital relationship between the two parties, which took place in a European country, despite the husband’s death two years after the marriage contract was signed. The marriage was not officially registered in Kuwait.
Lawyer Jarrah Al-Malik explained that his client married the Kuwaiti citizen through a customary marriage contract concluded in a European country, with a dowry paid and the consent of her guardian. However, the contract was not officially registered in Kuwait by the husband, who died two years after the marriage. He said the Court of Appeals ruled in favor of his client, confirming her marriage to the deceased relative of the respondents, who had denied the marriage in an attempt to deprive her of her inheritance
