Court annuls case against ‘former chairman’ of KAC

KUWAIT CITY, Jan 18: The Court of Cassation overturned the verdict issued by the Court of Appeals and the Court of First Instance which obliged the former Chairman of the Board of Directors of Kuwait Airways Yousef Al- Jassem to return the amount of KD 243,000, which is the value of the allowances he had received unjustly.

The court instead ruled to reject the lawsuit filed by Kuwait Airways Corporation. Commenting on the ruling, Al-Jassem said, “We thank Allah for the ruling. I appreciate and honor the Kuwaiti judiciary, its justice and integrity, which is a reference for all of us in obtaining our rights. The court issued its fair and final ruling to reject the lawsuit filed against me as a former Chairman of the Board of Directors of Kuwait Airways Corporation during the period from April 1, 2018 to August 13, 2020 to return the allowances that were granted to me at the time by the former Minister of Finance and Chairman of the Board of Directors of the Public Authority for investment Dr. Nayef Falah Al-Hajraf.


In accordance with the just ruling issued by the Court of Cassation, our honorable judiciary whose justice we seek to protect in our dear homeland Kuwait, has done justice to me before Allah and all people. It affirms the values of integrity, honesty, competence, and dedication that I grew up with throughout my personal and professional career of more than fifty years in Kuwait Airways Corporation and the other entities where I worked, maintained their trusts, and maintained their systems and laws. Everyone bore witness to that.”


Al-Jassim extended his appreciation to the judiciary and the lawyers who defended him voluntarily or on retainer. He also expressed his gratitude and appreciation to “my brothers, sons, family and honorable friends in Kuwait who supported me during periods of litigation and were my best support and helper after the Almighty. As for those who tried to exploit the case and sought to harm my personal and professional reputation and dignity for their own purposes, I say that Allah is sufficient for us, and He is the best disposer of affairs.”


Meanwhile, informed sources affirmed the fairness of the Kuwaiti judiciary, highlighting at the same time the arbitrariness of the Kuwait Investment Authority, as it is the party responsible for Kuwait Airways, which filed the lawsuit, questioning the role of the legal administration in it, accusing others and preoccupying the judiciary. It is noteworthy that the Court of Appeals upheld the ruling of the Court of First Instance, obligating him to return this amount, which is the value of salaries and benefits that he received “unjustly” in a lawsuit filed against him by Kuwait Airways at the end of 2021.
