Court acquits sports TV presenter in libel charge

KUWAIT CITY, Jan 27: The Criminal Court acquitted the presenter, producer and guests of a sports program on a TV channel of charges of offending the Secretary General of Kuwait Football Association. According to the case file, the Public Prosecution had charged the first, second and third defendants of broadcasting a sports program that broadcasted false statements and fake events which offended the plaintiff, the Secretary General of Kuwait Football Association. The sports program was prepared and presented by the first defendant and directed by the second defendant. The third defendant is the owner of the TV channel and the fourth defendant had agreed with the defendants to broadcast the program on that TV channel. During the court session, the defense counsel of the fourth defendant Lawyer Ina’am Haidar highlighted the lack of material or moral crime, stressing that her client has been denying the allegations since the start of the investigations. She insisted that the case file does not contain any evidences in support of the allegations, affirming that his statement was issued based on the freedom of sports criticism, which is guaranteed and legal. She added that his statement did not contain any insults or threats.

Case adjourned: Under tight security at the Justice Palace, the Criminal Court adjourned to March 13 the case filed against former MPs Musallam Al-Barrak, Mubarak Al-Walaan and Salem Al-Namlan and political activist Abbas Al-Sha’abi, who are allegedly accused of offending the King of Jordan, for cross-examination of witnesses. The Public Prosecution had charged three suspects of spreading fake news concerning the internal situation of Kuwait with the intention to harm the national welfare of the country. Al-Barrak was accused of claiming that there are 3,500 Jordanian security personnel in Kuwait during an interview in a French TV channel. They were also charged of participating in an illegal gathering with others, and failing to adhere to the orders issued by securitymen to disperse. The defendants had denied all the charges.

‘Refund KD 10,500’: Civil Section at the Court of First Instance chaired by Judge Khalid Al-Rushdan ordered a Kuwaiti woman to refund KD 10,500 in favor of her compatriot ex-husband for making use of a sold property illegitimately. Lawyer Mohammad Khalil Al- Qattan representing the plaintiff narrated before court that his client was married to the defendant. He explained that his client sold his property at Oyoun area, Jahra, but the defendant used the same property for over 10 months after the sale. He stressed the action made the plaintiff to pay the buyer KD 700 monthly, citing Article 262 of civil law, which stipulates that whoever enriches himself at the expense of another person should compensate the affected person for damages.

Decision cancelled: The Cassation Court presided over by Judge Dr Jamal Al-Enezi cancelled a decision to delegate and promote a holder of PhD in Law to the position of director of Legal Affairs Department of State Ministry for National Assembly Affairs. Ayed Al-Mutairi had filed a lawsuit against the State Minister for National Assembly Affairs in his capacity, demanding the cancellation of decision No. 20/2010 dated Jan 25, 2010 that bypassed him from delegation and promotion to the abovementioned post. He also demanded cancellation of Decision No. 69/2011 issued in February 2011 that bypassed him from delegation and promotion to the same post.
