KUWAIT CITY, July 5: The Misdemeanor Court acquitted an individual of disturbing people and being drunk in public due to the invalidity of the arrest and search procedures and because he was found in an abnormal condition inside a hotel, which is a closed place, not a public location, reports Al-Seyassah daily. Case files indicate that the hotel’s security reported a fight and damage to property inside a villa belonging to the hotel, along with suspicions that the suspects are in an intoxicated condition. Police officers arrived at the scene, arrested the suspects, referred them to the police station, and then to the court. During the investigation, one of the defendants denied the charges in the presence of his lawyer, Attorney Walid Masoud, who proved the invalidity of his client’s arrest and search. Masoud added that his client’s intoxicated condition did not justify his arrest, asserting that referring his client to the Criminal Evidence General Department is invalid, because it is a violation of Article 80 of the relevant law, and that the evidence is inadmissible since it is based on invalid arrest procedures.
