KUWAIT CITY, Aug 14: The Juvenile Court acquitted a Kuwaiti citizen who was accused of swindling KD 29,000 from a Kuwaiti woman. According to the victim’s testimony, she met the suspect in 2012 when he introduced himself as a trader of spare parts for vehicles and claimed that he is a member of a family specialized in this profession.They kept in touch and eventually he convinced her to invest in the business. She gave KD 29,000 but she later discovered in 2013 that he is not a part of the family that he claimed. When the citizen was interrogated, he denied the claims of the victim, revealing that he had received KD 29,000 from her but he returned KD 31,500. He affirmed that the project is real but the allegation against him was raised because she wanted to marry him.The defense counsel Lawyer Bashar Al-Nassar said the plaintiff’s claim that his client stopped calling her from 2012 to 2013 is false, especially since she had filed the lawsuit in 2014. Lawyer Al-Nassar insisted that the accusations against his client are malicious and fake as well as lack evidences. He stressed that his client said the truth and admitted to receiving KD 29,000, indicating that he would have denied receiving any money at all from her had he been a swindler in real. Lawyer Al-Nassar affirmed that the project is real but swindling generally occurs for fake projects.Fine overturned: The Court of Appeals overturned the verdict issued by the Court of First Instance which imposed a fine of KD 1,000 on the defendant for constructing a structure without obtaining necessary license. The court ruled in favor of the defendant but demanded that he sign a pledge of good conduct. The Public Prosecution had charged the suspect of erecting a structure without obtaining permit from Kuwait Municipality. The Court of First Instance had fined him KD 1,000 and ordered the removal of the violating structure. The defense counsel Lawyer Zainab Al-Ramzi stressed the invalidation of the citation for lack of describing the violating works or determining its substance, highlighting that it came with contradictions to his statements. She called for the acquittal of her client and suspension of the punishment in accordance with article 82 of the Penal Code.Decision nullified: The Administrative Section at the Court of First Instance nullified a decision taken by Kuwait University rejecting the appointment of a Kuwaiti woman as an Assistant Professor in the Department of Mathematics at the College of Science, with the ensuing effects. Lawyer Abdullah Al-Theyab representing the plaintiff filed a lawsuit to challenge the decision by joining Kuwait University President and Dean of the college as joint defendants by virtue of their official positions. He prayed the court to declare the decision null and void and premised the plea on the fact that his client satisfies all conditions contained in the advertisement for the post, noting her application was accepted after which she attended the interview.
