KUWAIT CITY, May 24: The Administrative Court has reserved the first lawsuit, demanding the suspension of the implementation of the decision of the General Administration of Enforcement to permanently withhold a debtor’s salary, and enforce arrest and subpoena procedures.
During the court session, Attorney Hani Hussein, who filed the lawsuit on behalf of a citizen, submitted a memorandum requesting the referral of the new salary withholding law, as well as the arrest and subpoena laws, to the Constitutional Court for review.
The lawsuit calls for the cancellation of the salary withholding order and the enforcement of the arrest and subpoena decision instead. This case is the first of its kind and comes amid ongoing legal and social debates over the practice of withholding salary, and the arrest and subpoena procedures.
