Companies inquire about MOCI’s new decision for special licenses

KUWAIT CITY, July 25: Several companies have submitted inquiries to the Ministry of Commerce and Industry on ways to reconcile and amend their existing licenses to be in line with the decision concerning new licenses for activities of a special nature that do not require headquarters, reports Aljarida daily quoting informed sources. They explained that these companies intend to change their licenses, which are for companies with known headquarters and work in accordance with the previous requirements, into licences for activities of a special nature, especially those that issued their licenses recently. Their activity code is included in the ministerial decision.

The officials of the Ministry of Commerce and Industry are aware of this matter, but that this matter is under study. It will be according to the scenarios developed at a later stage, to discuss all its legal and technical aspects and the way to implement it without any obstacles or pitfalls. The Ministry of Commerce and Industry will consider examining these applications and submitting them through the Activities Classification Committee to convert the existing license into an activity license of a special nature, provided that it applies the required conditions.

The sources indicated that the next stage will be electronic. They explained that the required amendment must be in accordance with the provisions of the new Commercial Transactions Licensing Law, its executive regulations and ministerial decisions related to it. It must also be in accordance with the controls, as the legal entity of the company requesting the license is a one-person company, and the owner of the license must be a manager of the company.

The license allows the recipient to conduct his commercial business without the need to rent an office or shop. It is noteworthy that the Ministry of Commerce and Industry issued a ministerial decision regarding commercial activities of a special nature that will not require a lease contract, to issue a commercial license and carry out its business. According to the ministerial decision No. 86/2023, up to 54 commercial activities are allowed to be practiced and commercial licenses will be issued for them for a period of three years without the need to rent a headquarters. The current activities are considered preliminary. The ministry is studying the possibility of increasing it to more than 100 activities within the near future, as any entrepreneur can add any new activity within the international code of his trade license.
