CAPT Permanently Blacklists Company Under Article 85, Total Banned Firms Rise to 12

KUWAIT CITY, Feb 24: The Board of Directors of the Central Agency for Public Tenders (CAPT) approved the application of Article 85, Clause C of Public Tenders Law No. 49/2016 by permanently removing one company from the register. This brings the total number of companies recently barred from participating in tenders to 12.

The decision of CAPT is in accordance with the law and includes punitive measures against companies that fail to meet the requirements and deadlines for completing work on development projects contracted by ministries and government entities through the agency within the specific frameworks and contractual terms. Article 85 stipulates the penalties that CAPT imposes on contractors, suppliers or service providers.

These penalties include a warning, downgrading of classification, removal from the register, ban on participation for a period not exceeding five years, or permanent removal from the register. These penalties do not prejudice the contractual rights of the contracting entity, as stipulated in the contract terms. The newspaper published a report on Jan 4, stating that 11 companies were barred from tenders and the number has now risen to 12.
