‘Appeals’ quashes life in prison against Kuwaiti man in rape case – Court overturns 15-year jail verdict in drugs case

KUWAIT CITY, Nov 21: The Court of Appeals chaired by Judge Abdul- Rahman Al-Darmi overturned the verdict of the Court of First Instance that sentenced a Kuwaiti man to life in prison over allegations of raping his girlfriend.

The court acquitted the defendant regardless of confessing to the crime. Defense Attorney Jarrah Humaid Al-Shuraikah said the defendant had established an intimate relationship with the plaintiff and they both arranged to meet at a particular place from where they rode in a car together.

The woman requested the defendant to find an apartment that would be convenient for their meeting, but he took her to a desert area when he could not find any apartment and had canal knowledge of her in backseat of his car.

Later, he took her to an apartment and slept off but he could not find the woman when he woke up. The lawyer argued the law does not favor any woman above 21 years old who willingly agrees to sexual intercourse.

The Court of Appeals, presided over by Judge Adel Al-Huweidi, overturned the verdict of the lower court, which sentenced an inmate in the Central Jail to 15 years in prison for smuggling hashish into the jail.

The higher court pronounced him innocent. According to the case files, the Public Prosecution charged the defendant with possession of hashish and crystal meth with the intention of consuming the narcotic substances despite the fact that he is serving a five-year jail term with hard labor for his involvement in another criminal case.

Defense lawyer, Ali Al-Wawan, questioned the arrest and search procedures against the accused. He argued these procedures were carried out under conditions deemed illegal while asserting the only witness against his client was the arresting officer.
