Appeal fails to save Bangladeshi drug dealer from life term in prison

KUWAIT CITY, June 6: The Second Circuit of the Court of Appeals, presided over by Judge Nasr Salem Al-Haid and with Judges Mutaib Al-Aradhi and Saud Al-Sanea as members, overturned a ruling issued by the Criminal Court to acquit a Bangladeshi drug dealer and instead sentenced him to life imprisonment.

The court also upheld the 15-year prison sentence and KD 10,000 fine for his two accomplices, who are also Bangladeshi nationals. The Public Prosecution had charged the defendants with possessing cannabis (hashish) and psychotropic substances with the intent to traffic them. It also charged the second and third defendants with possessing heroin and psychotropic substances with the intent to traffic them.

The Public Prosecution also charged the second defendant with possessing hashish, heroin, and morphine for personal use. A drug enforcement team raided the home of one of the defendants in Abu Halifa based on confidential information. The defendant confessed about his accomplices and admitted to storing various quantities of drugs and psychotropic substances in Fintas, in the possession of the second defendant.

The third defendant was arrested in Mangaf in possession of various drugs. The Criminal Court had sentenced the defendants to 15 years’ imprisonment and a fine of KD 10,000 each, while acquitting the second and third defendants of heroin trafficking. The Court of Appeal overturned the acquittal of the main defendant (the second defendant) on heroin trafficking charges, sentencing him to life imprisonment on all charges due to their connection, and upheld the 15-year sentences for his two accomplices.
