Acquitted in adultery case

KUWAIT CITY, Sept 27: The Court of Cassation overturned the judgments of the Court of First Instance and Court of Appeals, which had earlier sentenced a citizen to two years in prison in an adultery case, reports Al-Seyassah daily. The Cassation Court declared the criminal case inadmissible because the wife failed to file a complaint against her husband. The Court of First Instance sentenced the defendant to two years in prison, a ruling upheld by the Court of Appeals. However, the defense challenged the verdict at the Court of Cassation, arguing that there was no complaint, which is required to initiate criminal proceedings. Attorney Abdulmohsen Al-Qattan, lawyer for the defendant, appeared before the Court of Cassation, arguing that the case is inadmissible, considering the wife did not fi le a complaint against her husband—a procedural step necessary for initiating prosecution in such a case. The highest court accepted the appeal for consideration, and ruling on its merits, overturned the decision of the lower courts.
