2 acquitted in bogus trading

By Jaber Al-Hamoud Al-Seyassah Staff KUWAIT CITY, Oct 18: The Misdemeanor Court acquitted two Kuwaitis (male and female) for engaging in bogus transactions at Kuwait’s Stock Exchange Market. The Public Prosecution charged the defendants for creating fake transactions to mislead people in the Stock Market. The first defendant allegedly introduced purchase order and canceled it later through the accounts of his two companies. He knew that the order was too close in terms of size, price and duration for buying and selling stock.

The second defendant was charged for having knowledge of the prank with her own input by purchasing some shares higher that their worth using the accounts of two companies. Defense Attorney Abdul-Aziz Al- Banwan denied the allegations against his clients, saying they lack evidences. He declared the prosecution officer and witnesses only made noise about the issue without strong proof. He further argued that Article 122 of Stock Exchange Market Law is not very definitive and categorical to the extent that the market operators do not understand the system of transaction, because the punishment is rather discretional than clear cut.

Ex-wife’s murder: The Criminal Court presided over by Judge Met’eb Al-Ardhi adjourned to Nov 29 the case in which a citizen is accused of murdering the ex-wife in Salwa area to review the mental evaluation report of the suspect from the Psychiatry Hospital. Attorney Tariq Al-Khars attended Sunday’s session and insisted on referring his client for psychological evaluation, and the court granted his request.

Case transferred: The Court of Appeals presided over by Judge Najeeb Al-Majid referred the case known as “Bargash family citizenship withdrawal” to another judge in the Court of Appeals to look into it, because the government side insists that the administrative court has no jurisdiction to handle the case. Defense team of Bargash family filed a petition challenging the decision to withdraw the citizenship of the family. In the previous session, the lower court chaired by Judge Ahmad Al-Dehan nullified the citizenship withdrawal decision against “Bargash family” and ordered KD 5,001 compensation in their favor. The defense team pleaded the children of Kuwaiti female from a Bedoun spouse were considered as Kuwaiti citizens before the cancellation of Article 3/1959 of Citizenship Law in 1981. Therefore, the nationality of Bargash’s family was based on Article 3/1959 of the Citizenship Law; the citizenship was not a grant by the Interior Ministry.

Bank worker absolved: The Misdemeanor Court presided over by Justice Abdurrahman Al-Bueijan acquitted a bank employee of insulting and humiliating a customer in public. Earlier, the employee filed a case with the investigation department accusing a customer of insult and eye witnesses corroborated her statement. Later, the customer also filed a complaint against the employee for humiliating her. At the session, attorney of the employee Lawyer Talal Saber Al-Enezi requested temporary compensation on behalf of his client after proving that the customer had actually provoked his client and insulted her in public. The court acquitted the employee and obliged the customer to compensate her.
