Teacher wins compensation

KUWAIT CITY, Dec 16:The Administrative Court of Appeals upheld the verdict to cancel the decision of the Undersecretary of the Ministry of Education, which was issued to assess the competence of a school teacher as a “technical instructor for decoration subject” for the year 2011 to a very good degree, and the consequent effects, and obligating the ministry to pay her KD 500 as temporary compensation, says Al-Seyassah .

The details of the case filed by the defense counsel of the employee Lawyer Ali Al-Wawan can be summarized as follows: On September 7, 1985, she was appointed at the Ministry of Education in the position of “practical studies teacher”.

She progressed in the position until she was promoted to the position of head of the department of a subject. She was then confirmed as Technical Instructor of Decoration through a decision. From the date of her appointment until 2010, she received excellent reports of competence until she was verbally informed by her line manager that her efficiency report for the year 2011 was very good and not excellent.

She strove to find out the reason for this, but to no avail, which prompted her to file a grievance. The administrative body abstained from responding to her grievance, which prompted her to file this lawsuit. Lawyer Al-Wawan demanded in his lawsuit to raise the annual assessment of her efficiency to “Excellent” and make her eligible to be promoted to the supervisory position of “senior instructor for practical studies” in any of the educational zones.

This is on the basis that she has always been requesting for the assignment of a supervisory position, because she meets the conditions for promotion to this position; however, her request was met with procrastination.
