KUWAIT CITY, Oct 4: The Public Authority for Manpower has put the finishing touches on the unified labor contract which is expected to come into force beginning of the New Year in 2016.
According to the new contract the employer will be obliged to provide the worker an air ticket after the completion of the service period.
This is in addition to the health insurance and end of service indemnity in accordance with the Labor Law of the Private Sector.
The new contract also states that the worker will be eligible for paid 21-day leave to perform Hajj after completion of two years of continuous service, provided the worker is performing Hajj for the first time.
The period of the contract will be open or limited as agreed between the employer and the worker. It can be for one year, renewable automatically at the end of the contract period.
The 100-day probation period is mandatory as per the contract. The unified contract protects the rights of the worker and the employer. Moreover, if there is any clause in the contract which does not concur with the articles of labor law in the private sector and its decisions, will be null and void.
All conflicts arising from the contract will be settled in court. The contract will be signed in three copies – one for the laborer, the employer and for the Manpower Public Authority.
However, specialized departments in the Ministry of Social Affairs and Labor will sometimes be empowered to settle disputes between the concerned parties.
On the other hand, sources said the same Ministry has withdrawn the licenses of three wedding halls — Sheikh Sabah Al-Jaber, Raja Al-Habbaj and Mohammed Hussein Qabazard — after the officials were found guilty of committing violations. The same sources said the ministry is looking into the possibility of withdrawing the licences of two other halls for the same reason over the next few weeks.
