‘Contractors to pay for damages’

KUWAIT CITY, Feb 4: The Ministry of Public Works (MPW) is currently studying the legal aspects of obliging contractors in the new maintenance contracts to allocate a certain amount as guarantee, which will be used to compensate roadusers if they file lawsuits against the ministry as a result of their cars being damaged by drilling or flying steel, reports Al-Rai daily quoting sources from the ministry.

Sources informed the daily that the ministry intends to obligate the contractors in the new contracts to shoulder the cost of cases filed by citizens or expatriates whose cars are damaged as a result of a defect in the maintenance works assigned to the contractors.

Sources explained that the affected person will not file a case against the ministry and the contractor together, as he will do so against the ministry only, since he considers the latter responsible for any damage to his vehicle. Therefore, the ministry will ask the contractors to allocate an amount in each contract to be used as compensation in case anyone is harmed due to their maintenance works, sources added.
