Court retains custody of child with mother studying abroad

KUWAIT CITY, Feb 6: In an unprecedented ruling on child custody cases, the Personal Status Court declared that a mother who completes her studies abroad is considered as honest and successful and not as a mother who neglects her children.

The court rejected a lawsuit that was filed by a man who demanded the custody his ex-wife had of their daughter to be transferred to him because of his ex-wife’s frequent overseas trips.

The legal counsel of the defendant , Lawyer Hawra Al-Habeeb said her client is the opposite of the plaintiff’s depiction of her. She stressed that her client’s frequent trips abroad are due to her endeavor to complete her academic studies, adding that the plaintiff’s arguments are misleading and undoubtedly misinformed.

Lawyer Al-Habeeb explained that pursuing education is a form of nurturing. When children see their mothers busy moving on with their lives after divorce and endeavoring to achieve the best in all aspects of life, it sets a good example for those children. This was something that the plaintiff failed to consider before accusing his ex-wife of negligence.
