  • Factory visa to Private sector Visa transfer – For those born in Kuwait

    Thank you for answering our queries. I have been reading your articles since a long time. However I have one query regarding visa transfer that my mandoop told me. I have been on a dependent visa since my birth in Kuwait until 2015.

    In 2015, I got a job in a factory and hence my visa was transferred from dependent to my current factory visa.

    However, my mandoub said that because my visa was transferred from dependent to factory, I can still apply for jobs in the private sector, after the mandoub from the new company completes some paper formalities.

    He also mentioned that had I come to Kuwait fresh, on a new factory Visa, I wouldn’t have been able to make the shift. Is this true? I’m really puzzled as the laws keep changing often. Awaiting your response.

    Answer: Yes, it is true that since you did not enter Kuwait on a factory visa, you will be able to make the shift and apply for a job in the private sector. The two mandoubs you have mentioned have therefore given you the true interpretation of the law

  • Various Clarifications on Termination, Final settlement, vacation etc

    I am working with a Korean company, having different subcontract works under Government Projects. I would like to get few clarifications about some points which are mentioned hereunder:

    1) Terminated employee, left Kuwait without employer’s permission / without visa cancellation which can be considered as absconding. He worked only 6 months under his one year contract period. He was not professional and that is the reason of termination. After 6 months from his absconding date, he is claiming his dues and still he is out of Kuwait. In this case, what is the final settlement eligibility for him? Is he eligible for

    (a) Final settlement such as air ticket, salary for the remaining period of contract (6 months), leave salary, etc.

    (b) Is it legal for him to claim his dues while he is working in Abu Dhabi currently.

    (c) Is it possible for him to take legal steps against company.

    (d) Understand that he took loan from local bank and not settled.

    2) Employees going on vacation and not coming back on time and extending the leave more than 7 days without any information to company or valid excuses. In this case, can we consider him as resigned as per Kuwait Labour Law. What will be his eligibility for final settlement?

    3) If an employee is under open contract, is it possible for the employer to terminate him with immediate effect and without compulsory notice period? Or ever open contract abides with 3-month notice period?

    4) Calculation of leave salary and indemnity are based on basic salary in my company. Is it right as per Kuwait labour rules? Or all allowance to be included?

    Answer: All things being equal, the company would have had to pay the employee for the remaining six months of the 12-month contract. He would have also qualify for final settlement which would include an air ticket if the latter was included in the terms of the contract.

    On the other hand, if the employee was sacked for not being professional, and if not being professional here means that he did not live by the terms of his contract, then he would have nothing to claim from his employer.

    In fact, leaving Kuwait without going through the necessary process to end his marriage with the company was wrong and the company can stand on this to deny him his end of service entitlements. As for taking legal action against the company, that is within his legal remit but as to whether he can get judgement in his favour is another thing which can only be decided by a competent court of jurisdiction.

    With regard to the unsettled bank loan, the issue is between the employee and the bank in question. The company can only be held responsible if they stood as guarantors to the employee.

    On your second question, the Kuwait Labour Law says that an employee who absents himself from work for seven working days without a valid reason for the action, will be considered to have resigned from his job. Yes, the employee under such a circumstance will be entitled for final settlement which will be in accordance with the number of years of service.

    The three-month notification period by both the employer and the employee is a stipulation under the Kuwait Labour Law and cannot be dispensed with.

    However, the Labour Law also spells out certain conditions under which an immediate termination of the contract by either the employer on the employee is permitted.

    We hope this answers your third question. According to the Kuwait Labour Law, indemnity should be calculated by using the latest remuneration which includes the basic salary in addition to all the allowance paid at regular intervals.

    Your company, (as indeed many other companies), is therefore wrong in considering only the basic salary in calculating the indemnity.

  • Father in prison can mother renew residence of children

    I am a mother of 2 kids (7 years old and 2 years old) my visa is 18 working with 450 KD salary. The father of my children was sentenced to jail for 5 years and under 1st appeal in the court, my son’s residency was already expired 2 months to date. Is it possible I can give him residency under my sponsorship and what will be the process?

    Answer: Under the law, it is only the man who is premitted to sponsor the children on family visa. However in rare cases and on compasionate, grounds, the Director General of Immigration Department can give a special dispensation and allow a woman to sponsor her child you may therefore book an appointment with the director-general and who knows, luck may smile at you.

  • Visit visa for daughter above 18 years

    Sir my daughter is 18 years and 6 months old unmarried I want to bring her to Kuwait on visit visa. I am working in semi govt organisation and my salary on izne amal is KD 396. Can I get visit visa for may daughter. I approached but my application rejected saying your daughter already crossed 18 years age. If yes pls explain procedure.

    Answer: Your daughter’s age could not have been the reason behind rejection of your application for a visit visa. If the officer at the immigration department based his/her reason on that then he/she was wrong.

    We suggest that you resubmit your application and make sure that you include the necessary documents required. These documents include your civil ID copy, copy of your rental agreement, copy of your work permit, copy of your daughter’s passport and an affidavit showing your relationship with the person you wish to invite.

    This affidavit (in Arabic) should be typed in your embassy from where you have to get it attested and also get the same attested by Kuwait’s Ministry of Foreign Affairs in Shuwaikh. Attach all these to application and submit it to the Immigration Department in your area. We must point out that your application might suffer another rejection if your wife is not staying with you here in Kuwait. We suspect that might have been the reason behind the first rejection.

  • Wife on family visa, Salary below KD 450 – Can we get dependent visa for new born?

    First of all I thank you sincerely for your legal services and clarification. I kindly request you to clarify my below question briefly.

    My wife has a valid iqama (family visa) until April 2017 and our baby is to be born in India by end of this month and my salary is below KD 450.

    Is it possible for me to get visa for my baby as me and my wife are having valid iqama here but I’m not familiar about this new law as each and every person quoting different law and don’t know what to do.

    So please explain me it will be much helpful for me in this time and will be very thankful for you and your team.

    Answer: If your wife’s visa is under your sponsorship, then you will have no problem in getting a dependent visa for the baby if she/ he finally arrives. If your wife is however still under the sponsorship of her father we are afraid you will not be in a position to sponsor the child because your current salary does not qualify you to do so. We must also point out that under Kuwait law, it is not permitted for a married woman to still be under the sponsorship of her father.

  • On medical grounds cannot continue to work during notice period

    On medical grounds I can not continue in my current job. Do I still have to work during notice period of three months. Is the company bound by law to waive my notice period on medical grounds.

    Answer: Yes, the company is bound to waive the notice period if you present a duly signed form by at least two medical officers from the Ministry of Health alluding to your condition.

  • Family visa queries

    I have been working in Kuwait since 2000. Presently working in Kuwait National Guard. My monthly salary is KD 438. May I get the family visa for my wife and kids. Please let me know. If yes what is the procedure to get the visas.

    Answer: We are sorry, you cannot sponsor your family on dependent visa because you do not meet the minimum salary requirement of KD 450 per month.


     

    I have applied for family visa, however by mistake I got visit visa. Now I want to apply for family visa again. Do I have to cancel the visit visa before applying for family visa.

    Answer: Your family has one month from the day of issue of the visa to enter Kuwait. So just wait for the one month to elapse and you apply for the family visa if your meet the salary cap of KD 450/- to qualify to sponsor your family on dependent visa.

  • Visit visa for relatives & validity

    I would like to know if I can get visit visas to enter Kuwait for my brother-in-law (wife’s brother), his wife and children. My salary is KD 540. Please advice.

    Answer: Yes, you will be able to get visit visas for your brother-inlaw, his wife and children as you meet salary requirement. You must however note that when the visas are issued they have to be used within one month. Also of note is the fact that your brother-in-law and his family will be able to stay in the country for one month only.


    Pls advise, if direct family members wife and kid got visit visa but they did not enter Kuwait after 2 months as validity of visa was only 30 days after issuance. My question is, can I apply for visit visa for them and get new visit visa?, since my residency will be issued again. It was temporary visa 14 for 1 month. Now they will issue new visa 18 and new civil ID. Will I have to give in writing to them any additional documents?

    Answer: Since your family could not enter Kuwait within 30 days after issuance of their visas, the latter are no longer valid. If you still desire to bring in your family on visit visa, you need to go through the same process as you did to get them the visas that are now expired. No additional information or documents are required for that purpose.

  • Change in designation & Release

    I am transferring from my father residency to a company. My title is storekeeper, I want to know whether I can change the sponsor within one year or I would have to wait one year to change residency to another company.

    I also want to understand whether the rules will remain the same for all job titles or rules will be different for different job titles. If you hold a university degree you can change a sponsor so long as your current sponsor is willing to give you a release. On the other hand, if your current sponsor insists on holding you we are afraid you have to complete the mandatory one year with him.

    On your second question, the rules remain the same if you operate under the open-ended contract. They may however change under a fixed-term contract.

    In fact the rules remain the same regardless of job title. I am a degree holder and have been working in this company as an IT manager for over 11 years, but my residence permit shows my designation as ‘Computer Operator’. My residence was renewed in December 2016 for two years.

    Now I have the assignment to handle our other office in Qatar and they say that with this designation I won’t get visa on arrival. So they have asked me to change it. I checked with our PRO who says it is not possible to change it before two years. Also wanted to know if it is possible then, if they change, will it affect my driving licence too. My salary is KD 750. Please advise.

    Answer: Your PRO is correct, you cannot do anything about the designation as reflected in your residence permit. The change can only be effected during the process to renew your residence. A change in designation will however not affect your driving licence. Only ‘driver’, ‘mandoub’, ‘housewife’ and ‘student’ lose their driving licences when they change their designations under current regulations.

  • Will my driving licence get cancelled if I change my job?

    I have an inquiry regarding my driving licence. I got my driving licence on May 26, 2014 and validity is till May 26, 2024. I got a new job in sales but my previous job was in an investment company and the profession on the license says Assistant Investment Officer. Will my licence get cancelled if I change to sales job? And if at all it gets cancelled will I be able to get a new one soon? Or is there a transfer of licence option? Because without licence there is no sales job. Please help me out with this inquiry as it will be of great help.

    Answer: No, your licence will not be cancelled if you change your job designation from Assistant Investment Officer to a sales job.

    Indeed, according to regulations currently in force, designation change that will lead to withdrawal of licence includes driver, student, mandoub and housewife.
