Violators face harsher penalties – PAM eyes draft to amend ‘provisions’ of labor law

KUWAIT CITY, March 28: The Public Authority for Manpower (PAM) said preparations are underway to draft a bill to amend certain provisions of the labor law, reports Al-Anba daily.

For example, it includes the amendment to (Article 57) which mandates transfer of salaries to banks which exempt certain categories.

The draft bill also includes amendments related to imposing harsher penalties commensurate with the size of the irregularities committed by some business owners.

The sources added, the proposed amendment to stiffen penalties includes (Article 138) of the Labor Law which states that punishment by imprisonment for a term not less than one year and not more than three years and a fine of not less than KD 1,000 and not more than KD 5,000 for whoever violates the law.

The punishment shall be according to the number of workers found violating the law and these employees shall be held equally responsible if it is found they worked hand in gloves with the employer.

The workers shall also be punished if they were found working for another rather than their sponsor and if they fail to report the name of the employer who sponsored them. The employer and the employee will be punished and the penalty shall be imprisonment of not less than one year and not more than three years.
