Pay dowry to wife: court

KUWAIT CITY, Dec 1: The Jafari Circuit of the Family Court ordered a Kuwaiti citizen to pay delayed dowry of KD 5,000 to his wife as well as the legal charges of the case. This verdict was issued despite the fact that marriage still continues. Representing the wife was Lawyer Dalal Al-Mutairi who presented at the court a portfolio of d o c u m e n t s which prove the right of her client to receive the dowry even though the marriage is still ongoing as per article 11 of the family law No. 12/2015. Lawyer Al-Mutairi also presented documents to affirm that the marriage has been consummated due to which her client deserves the full dowry as per the Jafari jurisprudence.

Verdict nullified: The Court of Cassation nullified the verdict of the Court of Appeal that sentenced a Lebanese expatriatemanager of a trading company- to three years in prison with hard labor and deportation after serving the term over the allegation of forging certificate for transfer of workers’ salaries. The apex court thereby refrained from pronouncing penalty against the defendant and obliged him to be of good moral conduct. The Public Prosecution Department accused the defendant of forging official documents with which he purportedly fabricated salary transfer certificate of the company for April 2015, while he claimed the document was issued at the Labor Inspection Department. He also forged work permit for a worker exploiting innocence of the concerned employee who accepted it as a genuine document. Defense Lawyer Nasser Al-Bashir affirmed that his client was guilty of both allegations but exonerated him of perpetrating the offense with criminal intent. He argued that forgery is not considered a crime until the suspect uses the document to alter the truth. He explained the documents were used for a true situation, which did not affect the true position of its usage.

Embezzlement case: The Court of Cassation upheld the decision of the Appeals Court to acquit some Kuwaiti and expatriate officials and employees in the Ministry of Awqaf and Islamic Affairs, in addition to a company manager, of forging official documents to facilitate embezzlement of about KD 2.714 million from maintenance contracts for mosques. Previously, the Criminal Court sentenced two of the accused to seven years in jail with hard labor, and dismissed one of them from his post and banned him from assuming any duty in the government sector. The court also fined them KD3,000 each. Another accused was sentenced to three years and four months in jail, fined KD 3,000 and dismissed from public work. The court did not issue a verdict on one of the accused, 16 others were fined KD 1,000 each and the remaining defendants were acquitted. The Public Prosecution charged the accused with facilitating embezzlement of the ministry’s funds by forging documents with the intention of using these documents to misappropriate money through one of the defendants who abused his position as supervisor of mosque maintenance projects in Ahmadi Governorate.
