No working outdoors from 11 am to 4 pm – Inspection teams to issue first warning if violation uncovered

KUWAIT CITY, June 1: Acting Director of the Public Authority for Manpower (PAM) Abdullah Al-Mutawtah said Law Number 6/2010 stipulates penalties concerning work in the private sector, such as those who violate the directive prohibiting laborers from working outdoors from 11:00 am to 4.00 pm during summer — particularly from June 1 to Aug 31.

Al-Mutawtah disclosed the inspection teams will first issue a warning in case a violation is uncovered, including instruction to rectify the violation and the grace period for doing so. Once the grace period ends, the teams will go back to see if the violations are corrected; if not, the case will be referred to the General Investigations Department at the Ministry of Interior which, in turn, will forward it to the concerned court.

The penalties include fine ranging from KD 100 to KD 200 for each erring laborer and closure of the company’s file until the violation is rectified, he explained. He advised employers to strictly comply with the law to guarantee the safety of their workers, considering the scorching heat during summer. He pointed out the decision is in line with Article 64 of the Civil Labor Law authorizing the minister of social affairs and labor to reduce the number of working hours for jobs which require much effort under harsh conditions.

He affirmed the implementation of the decision in the last few years met the satisfaction of companies as it is in the interest of the public and in accordance with the international criteria for protecting the rights of expatriate workers.
