‘Law biased, favors 68 Kuwaiti pharmacists’

KUWAIT CITY, Oct 30: Head of Union of Consumer Cooperative Societies Meshal Al-Sayer revealed that the deadline for closing down the pharmacies in the central markets of cooperative societies is November 15 after an agreement was reached with 67 cooperative societies to take such a step, reports Al-Anba daily.

He stressed that this decision is in response to the objection raised by the boards of directors of cooperative societies against the recent law of Ministry of Health concerning the pharmacies located in cooperative societies.

Al-Sayer said they considered the law as biased, in favor of 68 Kuwaiti pharmacists and against more than 850,000 Kuwaiti shareholders, adding that the pharmacies will be closed until the law is amended or sent to the Constitutional Court.

Meanwhile, Al-Rai daily reported that Head of Kuwait Pharmacist Society Waleed Al-Shammari said the closing down of the pharmacies is based on law No. 30/2016 and its executive decree, and not in objection to the law as claimed by the Union of Consumer Cooperative Societies.

He revealed that the reason is that the pharmacies located in cooperative societies do not obtain licenses under the name of Kuwaiti pharmacists. Al-Shammari stressed that the pharmacies in the cooperative societies are considered as a source of revenues based on the investment returns in favor of the shareholders, adding that the new law obligates the cooperative societies to rent out the pharmacy to a Kuwaiti pharmacist, and the cooperative society only receives the rent amount.

He highlighted that the executive decree of the law was not issued by Ministry of Health or Ministry of Social Affairs, adding that, according to the Fatwa and Legislation Department, a law cannot be implemented without the issuance of an executive decree.

Al-Shammari said the profession of pharmacy is of the medical field, due to which the license should be given to pharmacists, not cooperative societies. He revealed that the Constitutional Court had previously dismissed an appeal to suspend the implementation of the law, adding that nine pharmacies amended their status as part of commitment to the law, which is above all
