MoI clarifies about categories permitted to transfer residence

‘Each application varies in status’

KUWAIT CITY, Nov 3 : After the issue concerning transfer of residence permits sparked controversy, the Ministry of Interior decided to clarify about the categories that are permitted to transfer their residency from government agencies to other agencies.

It affirmed the possibility of transferring the visa to dependent visa under article 22 after studying each application submitted to it separately, reports Al-Qabas daily. In its response to the Ministry of Education’s inquiry about the categories allowed to transfer residency, the Ministry of Interior stated, “In order to apply for the transfer of residency to family visa under article 22, the applicant must visit the General Administration of Residency Affairs, where each application will be studied separately. This also applies to requests for transfer to article 24 visa (self-sponsorship)”.

Regulations
The Ministry of Interior explained that article 13 of ministerial resolution No. 957/2019 in the executive regulations of the expatriates’ residency law stipulates the permissibly of a temporary or regular residence permit for an expatriate born in Kuwait, or who entered the country based on the provisions of the articles.

The residence permit may be transferred from one type to another, and from one purpose to another, according to the rules set by the General Administration of Residency Affairs. The duration of the stay is related to its purpose and ends with the end of that purpose, even if that is before the end of its term.

Approvals
For visa under article 17, its transfer between government agencies requires the approval of the entity where the employee was working and the party that wants to appoint him, in addition to the approval of the Civil Service Commission.

As for the transfer of visa from the government sector to the private sector under article 18, it requires a work permit from the Public Authority for Manpower. Also, the profession to which the applicant is to be employed must commensurate with the profession in which he was working in the government sector, and with the specialization and the qualifications obtained by the applicant.

Conditions for transferring from government to family visa are:

1. A work permit from the Public Authority for Manpower

2. The profession that the applicant wants to work in commensurates with the profession in which he is working in the government sector

3. The profession must be based on the specialization and the qualifications obtained by the applicant.

Transfer approvals required:

1. Approval of the authority in which he was working

2. Approval of the entity wishing to appoint him

3. Approval of the Civil Service Commission.
