‘Labor should pay damages’ – Court upholds lifting travel ban

KUWAIT CITY, March 27: The Court of First Instance presided over by Judge Mohammed Bahman canceled a decision by the Ministry of Social Affairs and Labor to cut three days wages from the salary of the Head of Jahra Labor Department. The court obliged the ministry to pay the legal fees in addition to KD 1,000 for material damages. Al-Wardan, who’s the plaintiff, resorted to the Judiciary after the ministry accused him of violating ethics by issuing a press statement in his capacity as head of the syndicate of legal experts and criticizing the ministry and some its officials. The court verdict indicated the statement did not cause any harm or abused dignity or honor, adding he expressed his opinion without harming the public good.

Travel ban lift upheld: The Administrative Section in the Court of Appeals, chaired by Judge Hamoud Al-Mutawa, upheld the verdict of the Court of First Instance that lifted the travel ban on a Kuwaiti man who committed a crime in a GCC country, in line with the Constitution which guarantees freedom of movement or travel. According to the case filed by Attorney Ayed Al-Rashidi on behalf of the Kuwaiti, the lawyer said his client is married to a Saudi woman and their children are studying in Saudi Arabia. His client was shocked when the Drug Control General Department banned him from traveling due to his alleged involvement in a criminal case in Saudi Arabia, disregarding the fact that the concerned authority released him on personal recognition so the travel ban should not be implemented. He argued the travel ban is a violation of his client’s human rights as it prevented the latter from taking care of his children in Saudi Arabia. He further explained that the criminal case is a private issue which did not affect national image or interest of the country.

Citizen acquitted of manslaughter: The Misdemeanor Court acquitted a citizen of manslaughter and then dismissed a civil lawsuit in this regard. The citizen was accused of killing an Asian man by running over the latter with his car while crossing a road in Sabah Health District. Case files indicate the Public Prosecution charged the citizen with accidentally running over the victim but the defendant vehemently denied it, stating that the victim appeared suddenly in front of him and he could no longer avoid hitting him. Representing the defendant was Attorney Fureih Al-Kooh who told the court that the area of the accident is currently undergoing major road construction works and this necessitates pedestrians to abide by the traffic rules more than the drivers. Al-Kooh pointed out it was the victim’s mistake as he was not careful in crossing the road that led to his death, let alone the fact that the victim did not adhere to the traffic rules concerning pedestrian path.
