Judge throws out case filed by Kuwaiti woman against ‘royal’

KUWAIT CITY, Jan 4: The Civil Section of the Court of First Instance chaired by Judge Nawaf Buslaib dismissed a case filed by a Kuwaiti woman against a ruling family member (husband of the woman’s niece) on allegations that she encouraged the niece to misbehave with the husband and also incited her to commit immorality. The woman said she was surprised that the man had an effrontery to file a case against her demanding compensation of KD 5,001 which the court rejected.

For this reason, the woman decided to sue the man. Defense Counsel Khawlah Mubarak Al-Hasawi affirmed that her client did well by approaching the judiciary to fight for his right knowing the plaintiff’s action was based on bad intention and malice. She reiterated that her client did nothing wrong, so there was no reason for the woman to file the case.

Doctor wins right: In a unique judgment, the Administrative Court of Appeals dismissed a lower court’s verdict and upheld the right of a Kuwaiti lady doctor to receive KD 500 monthly housing allowance for the ‘married’ category retroactively from 4/2/2010, and the sum in arrears is valued at KD 38,000. On behalf of the lady doctor, Attorney Ayed Al-Ajmi said his client, who’s employed by the Ministry of Health, joined Ministry of Finance and Civil Service Commission to sue the employer. He noted his client was appointed in year 2000 by the ministry as PhD holder in Gynecology and Obstetrics, and she married a Kuwaiti employee of an unspecified oil company.

He explained his client and the husband did not enjoy any official housing allocation from the government. Therefore, she is entitled to housing loan for married people in line with Decision No. 5/2010 concerning employment and salaries of Kuwaiti physicians and dentists applicable from the date of appointment. He argued that his client is entitled to rent allowance even if her husband receives housing allowance from the oil company.
