Jail overruled

KUWAIT CITY, Feb 28: The Court of Appeals chaired by Judge Nasr Al-Heid nullified the verdict of First Instance Court that sentenced a Kuwaiti man to six years in prison over alleged falsification of official documents.

The court refrained from pronouncing a penalty against the suspect. The prosecution officer indicated he was investigating a case that involves the sibling of the suspect who left the country without any official record of his departure. It became clear the suspect’s brother had used his civil ID card to exit the country.

Further investigation revealed that his brother was banned from travel, and so he used the suspect’s civil ID card to flee to a GCC country with full knowledge of his family, and the act is considered falsification of official document. The suspect was arrested on his return to the country but he said he was compelled to travel using the civil ID of another sibling because he had to travel for surgery.

In his defense, lawyer Dalal Al-Mulla pleaded with the court for mercy and clemency, stressing her client did not take the action based on criminal tendency. She indicated he was not aware of his brother’s action, and that he was forced to take the latter action without any criminal inclination, noting he is an old man with ill health and the bread winner of his family.
