Dispute between ‘main’ contractor and sub-contractor arises over contract fees

Contract sold without ministry knowledge

KUWAIT CITY, Jan 24: A dispute has surfaced between the main contractor and a sub-contractor over the payment of contract fee, reports Al-Rai daily quoting sources from the Ministry of Public Works.

According to the sources the main contractor without the knowledge of the ministry ‘sold’ the contract to sub-contractors, the contract of the Juvenile Care Complex.

The sources pointed out that “the project, which was signed in March 2017 at a cost of 16 million dinars has a delay rate estimated at about 15 percent and faces many problems that hinder its handing over in time. The sources pointed out the fraud came to light when one of the subcontractors sought the help of the Ministry to demand his rights and complained that he had not been paid for the part of the work he had carried out on the project.

This prompted the ministry to form an Inquiry Commission to know the accurate situation. The commission discovered the project was sold by the main contractor to many sub-contractors without the written consent of the ministry which has the right to cancel the contract or to withdraw the project according to the terms of reference.

The sources pointed out that the main contractor “notified the Ministry of the cancellation of the contract with the subcontractor, and expressed his willingness to resolve the issue and address the imbalance that has plagued the project over the last period.”

The sources pointed out that the “ministry officials demanded legal action to be taken against the main contractor when the problem was discovered which also entitles the ministry the right to withdraw the contract, but no action was taken during the reign of former minister Hussam Al-Roumi and the current minister Jinan Ramadan.
