Court sentences Kuwaiti man, ‘Saudi son’ to prison in forgery

KUWAIT CITY, Feb 6: The Court of Appeals upheld the verdict issued by the Court of First Instance which sentenced a Kuwaiti citizen to sevenyear imprisonment and his “Saudi son” to seven-year imprisonment with hard labor. It also acquitted a Kuwaiti “poet” who was accused of forgery, according to lawyer Jarrah Al-Shariqa. According to the case file, the P u b l i c P r o s e c u t i o n accused the father (the first suspect) of forging the birth certificate of his son (second suspect) by claiming the latter was born in Saudi Arabia, which qualified him to receive Kuwaiti citizenship. The second suspect was accused of helping the first suspect commit forgery after providing the latter with pictures and money, as well as the fake name “Hamoud” to be added to the citizenship file in order for him to receive Kuwaiti citizenship. He then filed for marriage allowance of KD 6,000. Their forgery was discovered when the “son” went to the citizenship department and claimed he is 18 years old, even though he looked much older based on his physical appearance. The third defendant “the poet” was accused of colluding with the second suspect to embezzle public funds through claims of “marriage”. They were also accused of forging school certificates under the name “Hamoud” as per which he completed grades nine and ten. Even though his actual age was 35 years old, the documents showed that he completed grade 10 at the age of 16 years. However, the court did not find any evidences that indicated that the third suspect had colluded with the other two suspects in any of the crimes.

Jail for duo: The Criminal Court sentenced a Saudi citizen to 10 years imprisonment and a Kuwaiti to five years for joining the terrorist group DAESH. The court also fined an officer of the Interior Ministry KD 5,000 for possessing an unlicensed gun. Meanwhile, the Ministry of Interior nabbed a four-member terrorist cell affiliated to DAESH, including two Kuwaitis, a Gulf citizen, and an Asian expatriate.

Appeal under study: The Court of Cassation presided over by Judge Dr Jamal Al-Enezi is studying the appeal submitted by former MP Abdullah Al-Barghash against the government’s decision to revoke his Kuwaiti citizenship as well as that of his brothers. Lawyer MP Al-Humaidhi Al-Sebaie, representing Al-Barghash, requested the court to accept the appeal and cancel the decision to revoke his client’s citizenship. Earlier, the Court of First Instance had canceled the decision, finding it in violation of the law especially after Ministry of Interior did not submit any supporting documents. However, the Court of Appeals had overturned the verdict of the Court of First Instance under the conviction that Kuwaiti judiciary is not supposed to handle such lawsuits. Al-Barghash then submitted an appeal against this decision at the Court of Cassation, which decided to accept the appeal and is still studying the file, even though recommendations were made by the court prosecution to cancel the verdict of the Court of Appeals.

Citizen acquitted: The Penal Circuit at the Court of Appeals acquitted a Kuwaiti citizen who was accused of possessing hashish and two types of illicit drugs – methamphetamine and Chlonaziban – for consumption and sale without official authorization. According to the case file, the prosecution officer saw the suspect standing in a desert and approached him for verification of identity when he noticed a sachet containing the illicit drugs fall from him in the process. This prompted the officer to search the suspect especially after observing his disoriented state and nervousness. However, the defense counsel Lawyer Talal Sabr Al-Enezi faulted the evidences submitted against his client. He said the procedures leading to arrest of his client contravened provisions of Laws No. 43-44 and 53-57 concerning legal procedures and penal courts.
