Court rejects ‘doctors’ case against minister – Kuwaiti acquitted

KUWAIT CITY, Oct 12: The Administrative Court presided over by Judge Muhammad Al-Tamimi rejected a case filed by five doctors (doctorates) against the minister of Higher Education imploring the court to annul an administrative decision that appointed Dr Fahad Al-Hajiri as Dean of Higher Institute for Dramatic Arts. The case files indicate the five plaintiffs filed a case to demand annulment of administrative decision No. 63/2014 issued on July 10, 2014, alleging the appointment of dean of the institute was done against regulation No. 32/2010 that mandates the formation of a committee to interview and nominate candidates for the dean’s post. However, after cross-examination and presentation of the rules and regulations governing the institution, the court upheld the appointment of Dr Al-Hajiri as it was in line with the law.

Kuwaiti acquitted: The Court of Appeals chaired by Judge Hassan Al-Shimmari has acquitted a Kuwaiti of the charge of possessing hashish and a variety of illicit drugs for consumption. The Public Prosecution had earlier charged the suspect with possessing the contraband without proof of official authorization to consume the drugs. The Prosecution officer said he was on official duty when he caught the suspect in a disoriented condition, so he carried out a precautionary search and found on the man the drugs. However, the defense counsel Attorney Hanadi Shukrullah said the arrest procedures faulty. She argued the documents presented to prosecute her client did not conform to the law and that the Prosecution officer gave contradictory evidences. Meanwhile, the Commercial Court of Appeals has ordered a shareholding company to hand over the relevant documents, reports of experts and a copy of verdict for or against the company to a shareholder. According to the plaintiff counsel Attorney Mohammad Al-Mutawa, his client only realized that the company was involved in many cases during an ordinary general assembly. This was the reason why he urged the court to protect his financial rights by enabling him see all relevant documents.
