Court orders co to refund KD 111,000 to ‘property’ buyer

KUWAIT CITY, April 8: The Civil Circuit of the Court of First Instance has canceled a real-estate property sale, ordering the company that sold the property to refund KD 111,000 to the buyer and pay KD 5,001 as temporary civil compensation for the damages. The court also dismissed another claim made by the company, requesting for payment for the period of usage.

The plaintiff counsel Lawyer Fayez Shadid Al-Mutairi filed a lawsuit on behalf of his client to cancel the contract signed by the buyer and the company, because the company failed to register the property. He demanded a refund with compensation for the damages.

The company also filed another case, demanding the plaintiff should pay a certain sum for the period within which he benefited from the use of the property since the date of sale.
