Court acquits 2 Jordanians of cheating Kuwaiti partner – Aug 3 hearing set for lawyer

KUWAIT CITY, July 25: The Misdemeanor Court acquitted two Jordanians of swindling a Kuwaiti man to the tune of KD 65,000 — the value of partnership for importation of vehicles and heavy duty equipment from Jordan to sell in Kuwait. It then referred the case to the Civil Court.

According to the case file, the accused lured the plaintiff into a business venture with the intention of swindling him. They informed him about their plan to import vehicles and heavy duty equipment from Jordan to sell in Kuwait with high profit. They convinced him to pay customs duty for the consignments, so the plaintiff transferred the required amount into their bank account.

However, lawyer of one of the accused, Attorney Abdul-Rahman Al-Watri, countered the allegation against his client. He said there is no proof that his client planned to dupe the plaintiff.

He added the case is not under the jurisdiction of the Criminal Court because it is a civil case that should be handled by the Civil Court.

Aug 3 hearing set: The Misdemeanor Court has fixed the session of August 3 for the hearing of the State Security case filed against Lawyer Hani Hussein over the alleged spread of false information concerning the case of a Bangladeshi doctor.

It is noteworthy that the Public Prosecution had previously detained the suspect for 21 days in Central Prison. He had pleaded not guilty to the crime, insisting that he was acting in the best interest of the public by unveiling secret information.

Verdict nullified: The Court of Appeals nullified the verdict issued by the Court of First Instance, which sentenced an Egyptian expatriate to five years imprisonment with hard labor followed by deportation over alleged possession of hard drugs for consumption. The court instead refrained from pronouncing penalty and ordered the defendant to pay bail bond worth KD 500.

According to the case file, a policeman explained that he was on routine patrol in Ardiya area when he suddenly sighted the suspect driving his car in a zigzag manner. He then ordered the motorist to pull over for issuing him with a traffic citation. It was then that the officer saw some items used for drug administration and he confiscated the items. The suspect was also seen trying to conceal a plastic bag which the officer checked to find a whitish substance suspected to be hard drug. He further searched the car to find more quantities of the illicit substance. The officer arrested and referred the suspect to the concerned authority for prosecution.

However, the defense counsel Lawyer En’am Haider faulted the procedures followed for searching and arresting her client.

She accused the officer of carrying out illegitimate procedures due to failure in obtaining a search warrant, declaring that her client did not do anything that aroused suspicions.

Absolved in arms case: The Misdemeanor Court acquitted two citizens who were accused of possession of firearms.

The defense counsel Lawyer Ali Al-Ajmi stressed the lack of sufficient material and psychological evidences to convict his clients.

He urged the court to declare his clients innocent of the allegation, because the prosecution officer could not prove his case and his statements were contradicting.

The court agreed that the prosecuting lawyer could not prove his case beyond doubt, because all he presented were circumstantial evidences that could be true or false.
