    I am working with a Korean company, having different subcontract works under government projects. I would like to get a few clarifications about some points:

    1. Terminated employee left Kuwait without employer’s permission/ without visa cancellation which can be considered as absconding. He worked only 6 months under his one year contract period. He was not professional and that is the reason of termination. After 6 months of his absconding date, he is claiming his dues and he is still out of Kuwait. In this case, what is the final settlement eligibility for him? Is he eligible for

    (a) Final settlement such as air ticket, salary for the remaining period of the contract (6 months), leave salary, etc.

    (b) Is it legal for him to claim his dues while he is working in Abu Dhabi currently.

    (c) Is it possible for him to take legal steps against the company.

    (d) Understand that he took loan from local bank and not settled.

    2. Employees going on vacation and not coming back on time and extending the leave for over 7 Days without any information to the company or any valid excuses. In this case, can we consider him as resigned as per Kuwait Labor Law. What will be their eligibility for final settlement?

    3. If an employee is under open contract, is it possible for the employer to terminate him with immediate effect and without compulsory notice period? Or do even open contracts require a 3-month notice period?

    4. Calculation of leave salary & indemnity are based on Basic salary in my company. Is it right as per Kuwait Labor Rules? Or are all allowances to be included?

    5. When an employee is leaving on vacation, is it necessary to pay his food & accommodation allowance during the vacation period?

    From your questions it is clear that you are asking them on behalf of your company and we will do our best to clear your doubts.

    1. First of all, a person who leaves the company without notice or without completing his contract and is absent for over 7 consecutive days is considered to have resigned. But in your case, this person worked for you for only 6 months and as such he is not entitled to any indemnity. He would have been entitled to indemnity only if he had worked for three years or if you had terminated his services. As things stand he can’t sue you for anything. In fact, the company can sue him for non-completion of contract. Even if the verdict is issued in Kuwait, it can be implemented in any GCC country. On the issue of the bank loan, this is personal issue between him and the bank unless the company was a guarantor in any way.

    2. All those who are absent for over 7 consecutive days are to be considered as having resigned, according to the Kuwait Labor Law. And they will be entitled to indemnity according —half if they have served three years or more but less than five years, two thirds if they have served five years but less than 10 years and full indemnity if they have 10 years or more.

    3. All contracts — except fixed period contracts — require a three month notice. So, open contracts require a three-month notice.

    4. Calculation of leave salary and indemnity must be based on “remuneration”, according to the Kuwait Labor Law although most companies are in violation of this law as do otherwise. And “remuneration” is defined by the Kuwait Labor Law as the basic salary plus all the allowances paid regularly. So, if you want to follow the law you must include the allowances in the calculations.

    5. And lastly, both the housing allowance and food allowance must be paid with the leave salary. The only allowance not included for this purpose is the transport allowance.

     

  • Letter of resignation

    Dear sir, what is the limitation for a letter of resignation to be accepted? For example, if a letter is given to the employer on the 1st of August, how long can the employer take to accept it? Can he accept the letter after 2 months when the notice period for the initial date ends?

    Answer: Your employer should address the letter upon receiving it, however there are employers that disregard it for a certain period , which is why it is advised for one to always follow up on resignation letters, in order to ensure that all necessary actions related to your resignation are executed. If issues arise due to the negligence of your employer, then you can visit the Public Authority for Manpower (PAM) and seek a more solid advice on how to address the matter at hand.

  • Bringing wife on dependent visa – Salary below KD 450

    I have been working in Kuwait for the last 4 years as an engineer. My salary is KD 350 and have an engineer’s visa from the company. Can I bring my wife from India on a dependent visa?

    Answer: I’m afraid not, as the minimum required salary for an article 17 resident to issue a dependent visa for a spouse or child is KD 450 or KD 650 for an article 18 resident.

  • Is there any chance of changing visit visa to family visa?

    I have a question about the new rules? I am working in Kuwait with my basic salary KD 400. My wife is also on dependent visa. My baby was born in India. She was 4 months old when she entered Kuwait on a visit visa, before the new rules came out. Is there any chance of changing visit visa to family visa?

    Answer: Although you are already in Kuwait and your wife is already your dependent it is very likely that the Immigration Department will grant you the visa for your child. In case you run into a “no”, file an application with the head of the Immigration Department. He has the authority to waive all the requirements and grant you the visa.

  • I cant take it anymore

    I want to ask about my resignation. I don’t want to go to work because I can’t take it anymore. I want to quit because of a low salary. There are duties and bad schedules that I cannot manage. I want to tender my resignation but I don’t want to go back to duty. Is this okay. While waiting for my departure, can I get a release even it is only 6 months that I have been working in Kuwait. I was hired in the Philippines. And am so worried that I may be required to pay for my company getting me a working visa?. Please help me.

    Answer: Unfortunately, as you were hired from abroad, you need to work at least three years before you can get a transfer to another employer. Even if he wanted, the sponsor can’t give you a release before three years. So, if you want to leave, you have to give a three-month notice. After that you will be required to leave the country. There is nothing you can do. Moreover, your sponsor can claim all the expenses incurred on your hiring and your documents.

  • Getting Release

    I have been working in a private company since March 2013 as an engineer. Actually I got this job through an interview in India, and my employers sent me a visa. Now I have got a new offer from another private company. So I would like to resign from here but I have not informed the company. My doubt is that whether I will get a release from company because I have completed 3 years and 8 months. What are the new Kuwait rules for getting a release? Please clarify my doubts.

    Answer: You have to apply for a release from your current employer and can’t obtain a transfer without “a release”. Now, the requirement is to work at least three years for the employer before asking a release. And if, after three years, the employer refuses to give the release you have to approach the Ministry of Social Affairs & Labor, through the Labor Office in your area. The Ministry has the authority to sanction such transfers and does so in most of such cases.

  • Visa for new born – Can we club our salary?

    My salary is KD 250 but my wife is working as a MoH staff nurse and her salary is KD 750 … so can we get a visa for our newborn baby born in Kuwait?

    Answer: As your salary doesn’t meet the salary cap, your wife can’t sponsor the child nor can you club your salaries according to the latest laws, the best thing for you would be to approach the head of the Immigration Department who has the authority to waive the salary condition.

    We are sure that as you and your wife combined earn enough, and the child was born in Kuwait, you will be able to get residence for your newborn baby.

  • Bringing baby to Kuwait but salary below KD450

    I am an Indian. My husband is working in Kuwait. Now my job visa is OK. My husband’s salary is KD 250. We want to bring our 10-month baby girl from India. Will we get a family visa for baby? If not, is there any other option to bring our baby to Kuwait?

    Answer: It is going to be very difficult, especially with the baby already in India, as you are not allowed to club your salaries and the husband’s salary doesn’t meet the KD 450 requirement. Although the rules on the issue are being strictly implemented, you should submit a request to the Director General of Immigration to waive the salary limit and grant you the visa

  • Will change in designation affect driving license

    When I received my driving license, my designation was mentioned as purchasing supervisor. Since my residence is due for renewal and my current role is HR Officer, will my license be affected? Please do let me know if my designation has to be the same as per my license. I fulfill the other 3 criteria for license, hold a valid attested degree certificate, have completed more than 2 years in Kuwait and my salary is over KD 600.

    Answer: Please always remember, on the issue of change of designation, you won’t be affected unless you get the license for the designations of ‘driver, student, housewife or mandoub’ and then change to another designation. In such cases only will the license be cancelled. You won’t be affected if you get the license for other professions and then make a change.

  • Salary cap for stamping residence of new born in Kuwait

    My husband and I are earning less than KD 450 and I will deliver my baby here in Kuwait this January, so my questions are: Is there a salary cap for applying for a visa for my baby under the new law 2016 while we are both under Visa 18. If we can’t make a visa for my baby, what will happen?

    The above question and the one following were dealt with last week but our attention was drawn to the inaccuracies found in the answers given. We are therefore repeating the questions to cure the inaccuracies pointed out. Since you and your husband are on Visa 18, the salary cap of KD 450 is applicable to your husband as he is the one legally permitted to sponsor your child. Under the new residency law you and your husband cannot club your salary to satisfy the KD 450 cap. In this case it is only the Director-General of Immigration who can take decision on the issue.
