  • Passport seized by sponsor

    My question is in regard to my passport. I worked for a company for over five years and I had to file a case to be able to get a release. I finally received my release now and I am trying to get my passport; my old employer took my passport when I was first hired and she has the passport and she refused to return the passport. What is my legal option to be able to get my passport back?

    Answer: You need to go back to the official who handled your release issue and report back to him or her that your employer is refusing to give you back your passport despite a judgement given in your favour with regard to your release.

    If you however don’t make any headway with the head official, we advise that you file a case at a court to seek redress. To be able to do this successfully we suggest that you involve your embassy if you have one which may help you seek the services of a lawyer to fight the case on your behalf.

  • Absconding case registered – Can I take advantage of this Amnesty

    My visa is Article 18, and my sponsor registered a complaint against me that I ran away (Thagayub), therefore my residency has expired, can I use this amnesty to leave the country? If I can not what do I have to do to leave the country?

    Answer: Under the recently issued Ministerial Decision No. 64/2018 stipulating regulations for expats whose residency applications were rejected or those with expired residency permits to rectify their permits or leave the country.

    The situation you find yourself falls under Article 4 of the said regulations. Article 4 states that expatriates who violated the residency law with administrative or judicial obstacles that could prevent them from leaving the country should visit the Residency Affairs General Department to know the conditions under which to leave the country or obtain residence permit according to the rules and regulations stipulated for the period running from Jan 29, 2018 to Feb 22, 2018.

    Our advice to you therefore is that visit the Residency Affairs General Department for guidance as to what to do.

  • Company situation is not good – Want to resign but company not accepting resignation

    First all, I would like to express my sincere appreciation to Arab Times legal clinic wing for providing such a helpful information. I am a BE graduate (certificate attested) and came to Kuwait on a government project visa in 2008.

    My visa locally transferred in 2015 to my current company under government project through the procedure of KD 300 paid to Ministry.

    Now 2 years completed in this company. My company current situation is not good so that I submitted my resignation in Oct 2017 and 3 months notice ends by next week.

    My current company not accepting my resignation and asking me to provide a replacement in order to leave the company otherwise should continue till end of the project. Until now company is not recruited any one and not ready to accept my resignation.

    Now I have another company government project visa ready to offer me.

    1) Please advice me what should I do next?

    2) Am I eligible for 2nd local transfer?

    3) If I need to approach the Ministry of Labor department then kindly advice when should I approach? How should I approach? What all documents should I carry with me? Appreciate your valuable reply

    Answer: The company is wrong in not accepting your resignation and also asking you to provide a replacement before you leave. Since you were locally hired and also a holder of a university degree you were at liberty to quit the company at anytime you wanted but after having worked for the company for two years, the company cannot stand on legal grounds to deny you a release. If the company maintains its ground not to give you a release after the expiry of the 3-month notice period just file a complaint at the Ministry of Social Affairs Labour through the Labour Department in your area and seek redress.

  • Dependent Visa for unmarried daughter age limit

    I appreciate your response to our queries. I have a question regarding my residence renewal. How many days do I need to complete my renewal process? Since I have to go to my country immediately after I stamp my residence. Also we want to apply for dependent visa for our daughter who is above 21 years. I read some news online that mentioned we can get dependent visa for daughters who are unmarried.

    Answer: If all your documents and request for renewal are ready and presented by your mandoub (company representative), it takes just some hours and not even a day for the renewal process to be completed. As regard a dependent visa for your daughter who is above 21, this is possible in so far as she in not married and has not reached 24 years of age. When she attains age 24 you have to transfer dependent visa to a work visa or failing that leave Kuwait.

  • Factory visa transfer doubts

    I have been working with a factory visa for the past 6 years. I heard when I get a release I must transfer the same factory visa to another sponsor one time and that if I get release for the second time I can transfer my visa to any private or government sector is it true?

    Answer: The rules as they exist now say that if you have a factory visa you can only transfer to a new sponsor on the same factory visa and not to any private or government sector sponsorship as you indicated.

  • Lot of evidence needed when filing divorce case

    When filing for divorce because of spousal abuse, the first thing you must consider is the fact that being harmed means the relationship has reached a level where negotiations or simple talks are no longer beneficial in clarifying any kind of misunderstanding between spouses.

    It is even more difficult if parents cannot take care of their children properly because of fights between them such that the only solution to have a normal life is to split up.

    Courts witnessed the filing of a large number of divorce lawsuits against those who abused their spouses. The legal definition of abuse is not limited to inflicting physical harm as it can be done through other means like swearing, insulting or slandering. All these are acts punishable by the Criminal Law. There is a difference between being insulted directly (face-to-face) or being insulted in a text message or a phone call. If one of the spouses uses the phone to commit such crimes, law number 63 for the year 2015 on information technology crimes will be applied. This law stipulates imprisonment for a period not exceeding two years for those who commit such crimes. The Public Prosecution will investigate after the complaint is filed. If the act was carried out face-to-face, the investigators in police stations will look into the complaint.

    According to the Criminal Law, it is very important to note that a complaint filed in police stations must include evidence to ensure it is not just a false claim; unlike text messages as it is easier to show the messages to the prosecutor to prove the claim.

    If your spouse beat you or harmed you physically, you must obtain a medical report from the nearest hospital before going to the police station. This medical report will be your evidence and the key for starting an investigation. The investigator will not take any step unless he sees the report, although it does not mean this is the final report. The investigator will ask the Forensic Medicine Department to examine you to substantiate your claim. This is for the experts to determine if another person beat you, that you did not harm yourself and faked an injury to frame your spouse.

    However, a final note must be taken into consideration before taking these steps and it is for the expatriates. I noticed in most divorce cases I handled and criminal cases filed against spouses that the male spouse tries to blackmail the wife by canceling her visa or residency permit, so she will not be able to follow up the case or even stay in the country. Instead of being the victim, she suddenly finds herself in violation of the Residency Law and wanted by immigration authorities.

    Ladies, you have to be careful. You can transfer your visa to the company where you are working to save yourself and children. You have to take other steps. I am not saying this always happens, but it happens most of the time, because the male spouse knows that after beating and insulting you, the Central Jail will be waiting for him, so he will just send you somewhere far where you cannot do anything.

    Remember, the Family Law stipulates presentation of a lot of evidence when filing a divorce case. I explained some of them previously. You must have a strategy that will help you instead of losing your life.

  • Validity of driving license – changed visa from 17 to visa 22

    I had renewed my licence for two years as per my residency (visa 17) in 2017 when I was working as a computer Eng. I then shifted to a dependent visa 22 (under my father) at the end of December 2017. I would like to know if I am permitted to drive using my licence that is valid till 2019 even though I am on visa 22.

    Answer: While it is possible for someone on dependent visa 22 with the designation ‘housewife’ or ‘student’ to be issued a driving licence and since you do not fall under these two categories, we are afraid that your licence will be invalid after your change of visa 17 to visa 22.

  • Wife sponsoring husband on Visit Visa

    I am from India and my wife is working in Ministry of Health Kuwait. I would like to know how my wife can get a visit visa for me. How long can I stay in Kuwait with that visit visa? What are the possible solutions to stay further there after the expiration of such visiting visa? Please advise me if any other kind of visa which enable us to live together? Expecting your earliest reply a.s.a.p.

    Answer: Your wife can invite you to Kuwait on a visit visa if she is earning KD 200 or more per month. If her application is accepted by the Immigration Department you will have one month within which to enter Kuwait.

    Upon entering Kuwait, you can stay for a maximum of three months without any possibility of extension.

    The only visa which can enable you to stay with your wife is when you secure a job that can earn you a salary of KD 450 per month or more and hence acquire a work visa which can either be visa 17 (government) or visa 18 (private).

    Under Kuwait law, a woman is not permitted to sponsor anyone on dependent visa. That right belongs to the man so in this case even if your wife is earning KD 450 per month or more she cannot sponsor you on dependent visa.

  • Jobs for Graduates below 30 yrs

    Currently i m pursuing a course in India in civil engineering and my age is 23. I want to know if I can apply for a job in Kuwait as an engineer below 30 years of age.

    Answer: Yes you can, if you possess the necessary qualification in civil engineering. The proposal not to recruit graduates below 30 years has been deferred for more studies to be conducted on it before a definite stand will be taken on it. Until that is done the statos quo remains.

  • Salary not paid for almost 3 months

    This is regarding our salary which is delayed for almost three months now. We are working with an engineering and construction company with approximately 5,000 mixed manpower.

    We are afraid now because our company is not paying our salaries from Nov 2017 up to now, we are helpless because none of our complaints has been looked into by management. Most of our families back home are crying because the company is not giving any money to us for the past three months.

    Many employees also cannot depart Kuwait due to non-availability of cash settlement. Some travelled with a verbal agreement from the company that they will send their money through their bank account as soon as possible, but we think nothing has been sent up to now.

    Can you please advise us what we can do legally. From our understanding they are not interested to pay us. Is there any organization that will help us.

    What we want is, if they will not pay us, then they should send us to our country with our salaries and benefits, but it should be clearly made that everyone should receive their money before departure. Thank you very much for your time and reply.

    Answer: The company is in breach of the Kuwait Labour Law for not paying your salaries promptly and in your case for about three months. If you are convinced that the company has no intention to live up to its obligation by paying you the accumulated salaries, we advise that you file a complaint with the Ministry of Social Affairs and Labour through the Labour Department in your area to seek redress.
