  • Changing designation from Supervisor to Engineer

    I came to Kuwait one year ago with supervisor designation on Visa 18. I have engineer degree. I would like to know if my designation could change from supervisor to engineer (holding KSE NOC) in the same company. As my company told me that, they have rejected my papers. So can you please tell me if there is any such rule for transferring my visa? Your advise and comment will be highly appreciated. Please.

    Answer: All designation changes must be okayed by Public Authority for Manpower so if your company is telling you that the change was rejected we have no reason to doubt what you were told.   • Procedure to convert domestic visa to family visa

    Please my question is, I have married in Kuwait and staying with my wife with Kuwait original married certificate and we are having one baby girl but my wife is using domestic visa (20). And because my salary cap was little I couldn’t make family visa for her but now I have KD 450 salary and I want to ask the procedure or can the law permit me to do it?

    Answer: Now that you meet the salary cap, you can transfer your wife’s Visa 20 to Visa 22 which is also referred to as dependent or family visa. The only thing you need to do is to secure the signature of your wife’s current sponsor indicating that he has no objection to transferring your wife’s sponsorship to your sponsorship.

  • Diagnosed with TB in past now cured – can I apply for job in Kuwait?

    Assalamu Alaikum, actually I was diagnosed with tuberculosis. And I am completely alright now. Is it possible for me to apply for a job in Kuwait? Please let me know. Thank you

    Answer: It is no big deal applying for a job in Kuwait but what is important is going through successfully the medical exam you will undergo before getting a resident permit.

    What this means is that if you succeed in landing a job, you cannot take up the job if you don’t pass the medical exam. On the issue of being completely healed from tuberculosis, what we know is that a scar is always left in the lungs after treatment and such a scar will always show on subsequent X-rays that you will undertake.

    To be frank with you such a scar will pose a problem in your bid to acquire a resident permit in Kuwait even if you succeed in handling that problem during the medicals you undertake in your country. In a nutshell your chances of going through the medical or not is 50/50.

  • Driving license for Marketing Representative

    I need some advice from you. My Visa is renewed as Mandoub Tasweek (Marketing Represenative) as I am into marketing now. My salary is KD 650 in iznamal. Can I get the driving license for this designation? Please advise.

    Answer: In reality, designation doesn’t play a role if you want to apply for a driving license, so far as you meet the requirement of holding a university degree, earning a monthly salary of KD 600 or above, and having resided in Kuwait for at least two years since your first entry. It is only when you seek exemption from meeting any or all the above requirements that your designation plays a role as some professionals qualify to apply for exemption. For you information marketing representative do not qualify for such an exemption.

  • Want to leave company before 3 yrs of completion

    I entered Kuwait on May 7, 2018. Now I have another job offer with a good salary package. I am a university degree holder, so can I ask for release from my current employer to join the new company. Or is there any law that prevents me from residency transfer.

    Answer: If your current employer brought you from your country, the law stipulates that irrespective of your being a university graduate or not, you are to work for him for three years before you can ask for a release. On the other hand, if the sponsor does not object to your leaving his company after just one year, then a transfer can be effected for you to join the new company.

  • Is 3 months notice period mandatory to resign?

    If a company terminates employees with 3-month notice, is the employee bound to complete the 3-month notice period or can he leave early in case he finds a good opportunity?

  • Engineer wants to change designation due to KSE NOC issue

    I have been working as an engineer in Kuwait since November 2015. I got driving licence in April 2016 valid till April 2020. My current salary is KD 650. My residency expires in November 2019. Because of KSE NOC issue for engineers I want to change my position, for driving licence renew/new which position is eligible for me.

    I am currently on Visa 22 and has been in Kuwait since December 2018. I want to start working in Kuwait soon. What are the current rules for the transfer of visa 22 to visa 18 (private sector)?

On the other hand, if you don’t possess a university degree, then you have to spend at least one year in Kuwait before you will be eligible to effect the transfer of your visa 22 to 18.

  • Cancelling of Family Visa and sending family back

    I am an engineer and staying with my family on permanent visa. My current company is transferring me to a Saudi project. My Kuwait visa is valid up to Nov 18, 2019, and my family visa valid upto Oct 29, 2019. My company gave me visit visa for Saudi with multiple exit and entry. I will keep my family in Kuwait until their visa validity. I will send my family to India just before their visa expires. I just want to know that if I send my family from Kuwait permanently, do I need to cancel their visa or can I send them without cancellation. I requested to my company not to cancel my Kuwait visa upto Nov 18, 2019. If I send my family without cancelling their visa what will be the problems I might face.

    Answer: It doesn’t take much time to cancel the family visa so why not just cancel the visas before the family leaves Kuwait for good. Even though the visas will automatically be cancelled after six months outside Kuwait, you don’t lose anything by cancelling the visas but stand to gain everything if there are sanctions to be meted out for noncancellation especially if in future you want to come back to Kuwait with your family joining you later.
