Appeals overturns verdict – Four citizens acquitted of doing drugs

KUWAIT CITY, Feb 26: The Criminal Court acquitted four citizens of consuming hashish and other illicit drugs. They were allegedly arrested with banned substances inside their vehicle. According to the prosecuting officer, the four suspects were seen throwing something from the window of their car, as they approached a security checkpoint on their way to the chalets at Lulua Al-Khairan area. The officer who made the arrest ordered the four suspects to come out of their vehicle for checking and recovered more narcotic substances on two defendants with additional narcotic pills inside the car.

Representing the defendants, Lawyer Enam Heidar argued that her clients’ arrest and search procedures were conducted illegally. She noted the officer who arrested them had no arrest and search warrant from the Public Prosecution, while the prosecution presented narcotics that differed from those found on the first defendant. Meanwhile, the Court of Appeals overturned a lower court verdict issued in absentia against a person to serve 15 years jail term and settle KD 10,00 fine.

The court presided over by Judge Abdullah Al-Othman acquitted the suspect of possessing and consuming hashish. The Public Prosecution charged the suspect based on the statements of detective policemen. In his defense, Attorney Ahmad Al-Hamadi appealed the lower court’s ruling, and argued that the prosecution did not present any substantial evidence besides the detective’s testimony. Attorney Al-Hamadi pointed to an attempt to omit the testimonies of other detective officers, as they contradicted each other.
