5-yr-jail with hard labor upheld against Museilim in arms case

KUWAIT CITY, March 23: The Court of Appeals upheld the five-year jail sentence with hard labor imposed by a lower court on Twitter user Musaed Al-Museilim for the possession of unlicensed weapons, but acquitted him of offending the Kingdom of Saudi Arabia.

The Public Prosecution charged Al-Museilim with misusing mobile phone to offend Saudi Arabia through his Twitter posts, which were related to news on the death of the late King of Saudi Arabia Abdullah bin AbdulAziz Al Saud. Also, a rifle and a machine gun were found in the house of the accused at the time of arrest so he was charged with possessing unlicensed weapons. Previously, the Criminal Court released the accused on bail of KD 500.

Verdict overturned: The Court of Cassation overturned the verdict of the Court of Appeals which had cancelled the decision of the former Minister of Commerce Falah Al-Hajri nullifying the contract that was signed by the National Real Estate Company with the Free Trade Zone, reports Al-Qabas daily.

The Cassation Court rejected the company’s lawsuit and upheld the decision issued by the Minister of Commerce. The government lawyer said the decision of the Cassation Court means KD 4.5 billion will go into the State Treasure. It is reported that the company which was managing the Free Trade Zone area had committed several irregularities which had resulted in damaging the public money and this had prompted the Cabinet to intervene and give the company ample time to correct the situation but with no result and this led the then Ministry of Commerce to cancel the contract.

Bank employee acquitted: The Court of First Instance presided over by Judge Saud Al-Maimouni acquitted a bank employee of fraud and deception against a client by assisting her in securing a loan for financial benefit. According to the case file, the defendant swindled a certain amount from the plaintiff by giving her the impression that he can assist in paying back a previous loan so that she can secure a new one.

The plaintiff claimed that the defendant followed her to a finance company where he used his credit card to pay for the loan on her behalf and obtained a fake receipt. The defendant later asked her to make another payment. During the court session, the defense counsel Lawyer Ali Al-Ali insisted that betrayal of trust involve financial and moral aspects which are insufficient in this case. He faulted the investigative procedures carried out by the detectives, stressing that they did not reach the core of the issue in order to obtain the facts.
