KD 69,000 to parents of child killed Insurance firm to pay damages

KUWAIT CITY, Aug 5: The Commercial Court of First Instance presided over by Judge Mohammad Al-Enezi ordered an insurance company to pay KD 69,000 to the parents of a five-year old child who died in a traffic accident. Attorneys Abdullah Al-Afasi and Yousef Al-Husseini sued the company on behalf of the parents, insisting that the motorist, whose car had killed the child, had insured his car with the company.

The court withheld investigations over the accident due to the death of the motorist who was responsible for the accident that killed the child and injured the first plaintiff.

The lawyers demanded blood money of KD 10,000 and compensation of KD 150,000 for the emotional and physical harms their clients endured. They explained that the first defendant sustained 65 percent disability due to the accident and lost his source of income, demanding salary compensation of KD 10,000 for the loss of his job.

The court ordered payment of KD 10,000 as blood money, KD 9,000 as compensation for the injuries sustained by the father, KD 20,000 as compensation for the emotional damages sustained from the injury and KD 30,000 as compensation for the emotional torment the parents underwent due to loss of their child.
