Marriage certificate problems

I am a citizen of Portugal (Goan origin)... I recently surrendered my Indian citizenship, in December 2013 to be exact, and transferred my Kuwait residence to my Portuguese passport. I recently got married in Goa (May 2014) and I have a civil marriage certificate issued in Goa, India. I wish to bring my wife (Indian citizen) on a family visa to Kuwait.

My current salary is KD 550 and I have resided in Kuwait for 7 years. I have my Indian marriage certificate duly attested in India (along with Kuwait embassy stamp)... will I be able to get a visa without the bilingual relationship — marriage affidavit from the Indian embassy? I cannot get the affidavit from the Indian Embassy because I do not hold Indian citizenship... I also cannot get any bilingual document from the Portuguese embassy in Abu Dhabi as my marriage is registered in India and not Portugal. I also have my mother under my sponsorship as a dependent.

We would like to bring the following Indian law to your attention as we are sure it will serve you well: Under Indian law, Persons of Indian Origin (PIO), who have acquired foreign citizenship, are required to surrender their last held Indian passports to the nearest Indian Mission/Post immediately after acquisition of foreign citizenship. In view of this provision, PIO, intending to apply for Consular Services should surrender their last held Indian passports, obtain Surrender Certificate/Deemed Surrender Certificate/Renunciation Declaration (as applicable in individual cases in accordance with relevant rules on the subject) and then apply for Consular Services by submitting a copy of the Surrender Certificate/Deemed Surrender Certificate/Renunciation Declaration so obtained and other prescribed documents for the required service.

In cases where the PIO applicants for Consular Services have already acquired Indian Visa after acquisition of foreign citizenship or if they have obtained OCI/PIO Card after acquisition of foreign citizenship, they need to submit copy of their Indian Visa page or copy of their OCI/PIO Card (as the case may be) while applying for Consular Services. In short, PIO applying for Consular Services are required to submit EITHER a copy of their Surrender Certificate/Deemed Surrender Certificate/Renunciation Declaration or a copy of their Indian Visa page or copy of their OCI/PIO Card along with their application for Consular Services.

So, you can clearly see that you can obtain consular services at the Indian Embassy by submitting the above documents. After obtaining the affidavit from the Indian Embassy, you can get it attested from the Kuwait Foreign Ministry in Shuwaikh before applying for your wife’s dependent visa. You should have no problems.
